INTERIM ORDER
Dated: 30th
June 2003.
Under its interim Order dated 18.10.2002 in Case No.20 of 2002,
the Commission had provided certain interim relief, and directed that “this
interim relief shall be in operation for a period of three months only from the
date of this Order, or approval of the Energy Purchase Agreement win d/solar
power plant for (i) sale to MSEB and / or wheeling for self use, and (2)
wheeling for self use and/or sale to third party, whichever is earlier.” The period of 3 months was over long
back. The approval of the EPA
agreements referred to in the interim Order is separately under consideration
and a public hearing has been held.
2. Under their Applications dated 10.3.2003
and 21.5.2003, M/s REDAM and M/s InWEA respectively have sought, inter alia,
extension of the period of validity of the interim Order dated 18.10.2002
citing the financial difficulties in the absence of such extension. They were heard on 13.6.2003, and their say
considered to the extent of the plea for such extension, their other prayers being
either beyond the ambit or seeking to enlarge the scope of the interim Order
dated 18.10.2002, or separately under consideration and accordingly withdrawn,
as set out in the Record of Proceedings.
It was also submitted on behalf of MSEB that they had no objection to
such extension.
3. The Commission accordingly extends the
operational validity of the interim Order dated 18th October 2002
for a further period until the approval of Energy Purchase Agreement / Energy Wheeling Agreement (EPA/EWA) for
wind/solar power projects, which matter is separately under the Commission's
consideration.
