Short title, commencement and interpretation. – (i)
These regulations may be called the Maharashtra Electricity Regulatory
Commission (Fees and Charges) Regulations, 2000 |

It shall come into force on
the date of their publication in the official Gazette and shall also
apply to all applications pending before the Commission
as on date of the publication. It shall extend to the state of Maharashtra.
The Bombay General Clauses Act, 1904 shall apply for the purposes
of the interpretation of theses Regulations. |

In these Regulations, unless the context otherwise requires:-
‘Act’ means the Electricity Regulatory Commissions Act, 1998 (14
of 1998)
‘Commission’ means the Maharashtra Electricity Regulatory commission
(MERC), established under section 17(1) of the Act.
‘Chairman‘ means the Chairman of the Commission.
‘Secretary’ means the Secretary of the Commission.
‘Officer’ means an officer of the Commission.
‘Regulation’ means these regulations.
‘Proceedings’ means and include proceedings of all nature that the
commission may hold in the discharge of its function under the Act
and all the Regulations made thereunder.
‘Application’ means and includes all applications, complaints, appeals,
replies, rejoinders, supplemental pleadings, other papers and documents.
‘Schedule’ means schedule appended to these Regulations.
‘Fees and Charges’ means fess and charges mentioned in the Schedule.

Words or expressions occurring in these Regulations and not defined
herein but defined in the Act shall bear the same meaning as in Act.

Every application made to the Commission shall be accompanied
by fees specified in the schedule.
The fees payable under these regulations shall be paid by means
of bank draft or pay order, drawn in favour of the ‘Maharashtra
Electricity Regulatory Commission’, payable at Mumbai or cash.
The fee received by the Secretary of the Commission under these
Regulations shall be deposited in the bank account of the Commission
and shall form a part of the funds of the Commission.

(i) The penalty as would be ordered by the commission under section45
of the Act shall be paid within 30 days of the order of the Commission
imposing penalty or within such extended date as allowed by the
Commission.
(ii) Penalty shall be payable and the amount shall be deposited
in the same manner as provided under clause 4(2) and (3) of the
Regulations.
